I. The duration and summary scope of the contract:<\/strong><\/b>The construction period is 6 months. The project consists in the reconstruction of Kanina\u2019s road (from the Vlora to Kanina). The Works consist on reconstruction, landscape, urban regeneration and upgrading works. The road will be reconstructed in order to increase the assets, easing the movement of habitants and the visitors\u2019 access to the castle.<\/p>\n

\n3.1 (ii) Financial Capabilities. The criterion is not fulfilled. The level of the confirmed commitments to be carried out in addition to the amount of the Contract to be awarded, exceeds the Bidder\u2019s annual turnover for the previous year by a factor of 1.2, as detailed below:
\nThe value of the declared on-going contract (which has just started) \u201cReconstruction of Velipoja road, lot 3\u201d is 436,082,653 ALL.
\nThe value of the contract to be awarded is 209,060,719 ALL.
\nThe total value of the on-going contract + the value of the contract to be awarded is 645,143,372 ALL.
\nThis value is much higher than the turnover of the year 2016 (393,250,144 ALL) multiplied with a factor of 1,2.<\/p>\n
\nThe bidder has submitted the following contracts:<\/p>\n
\n2. Paving \u201cThree Leskovik Bridges\u201d started in 08\/2009 and completed in 12\/2016. Value of works is 691,741,463 ALL executed by Riviera nd Cobein by 65% and 35%. Riviera executed works of 449,631,950 ALL. It is considered as Specific Construction Experience.
\n3. \u201cReconstruction of road Tamare \u2013 Vermosh lot 1\u201d. \u201cRiviera\u201d shpk is subcontractor of \u201cConsorzio Stabile EBG\u201d. Therefore it is not considered as Specific Construction Experience.
\n4. \u201cReconstruction of road Tamare \u2013 Vermosh lot 2\u201d. \u201cRiviera\u201d shpk is subcontractor of \u201cConsorzio Stabile EBG\u201d. Therefore it is not considered as Specific Construction Experience.
\n5. \u201cConstruction of Ajasem \u2013 Dajc \u2013 Gomsiqe road\u201d started in 2010 and completed in 2012. Value of works is 226,754,887 ALL and executed by JV Riviera & Holding by 49% and 51%. The value of works executed by \u201cRiviera\u201d shpk is smaller than the requirement value.<\/p>\n
\nThe Bidder fails to fulfill the sub-requirement for Asphalt and binder layers Works: it has completed 44,529 tons as opposed to 58,500 tons requested. These volumes are executed in the following contacts:<\/p>\n
\no \u201cReconstruction of Tamare Vermosh lot 2\u201d – 15,371 tons
\no \u201cReconstruction of road Leskovik\u201d – 14,002 tons.<\/p>\n
\nThe level of the confirmed commitments to be carried out in addition to the amount of the Contract to be awarded, exceeds the Bidder\u2019s annual turnover for the previous year by a factor of 1.2, as detailed below:
\nReferring to the Public Notices Bulletin, the bidder has signed a contract on 19.06.2017 with the National Agency Water and Sewage, for the reconstruction of the water supply Elbasan, with a value of 395,437,204 ALL and it has not declared this work.
\nThe value of the on-going works (declared and non-declared) is 453,877,195 + 178,959,748 x 0,6 + 381,863,431 + 395,437,204 = 1,338,553,678 ALL.
\nThe value of the contract to be awarded is 209,060,719 ALL.
\nThe amount of the on-going contracts in addition of the amount of the contract to be awarded is 1,547,614,397 ALL.
\nThe Bidders annual turnover for the year 2016 (referring to the declaration of construction turnover) is 1,070,172,264 ALL.
\nThe amount of the on-going contract in addition of the amount of the contract to be awarded, exceeds the Bidder\u2019s annual turnover for the year 2016 by a factor of 1.2.<\/p>\n
\nThe bidder submitted the following contracts:<\/p>\n
\n2. \u201cConstuction of road Dragobi Valbone\u201d started in 06\/2012 and completed in 11\/2015. Value of works is 563,772,171 ALL. It is considered as Specific Construction Experience.
\n3. \u201cRembec Plase road\u201d started in 2013 and completed in 2014. Value of works is 247,793,100 ALL. Works are executed by JV \u201cCurri\u201d shpk & SMO. 60% and 40%. The value of works executed by \u201cCurri\u201d shpk is smaller than the requirement value.
\n4. \u201cConstruction of water supply Kukes\u201d, started in 2011 and completed in 2013. This contract is not considered similar.
\n5. \u201cConstruction of water supply Malesi e Madhe\u201d. This contract is not considered similar.<\/p>\n
\nThe Bidder fails to fulfill the sub-requirement for Asphalt and binder layers Works: it has completed approximately 16,191 tons as opposed to 58,500 tons requested. These volumes are executed in the contact \u201cConstruction of Road Dragobi Valbone\u201d. The quantities of the asphalt and binder layers works (according to a final situation) of this contract are as follows:
\nAsphalt 73,222 m2 x 0.04 = 2,929 m3
\nBinder 76,180 m2 x 0.06 = 4,571 m3
\nAsphalt 3,136 m2 x 0.04 = 125 m3
\nBinder 1,180 m2 x 0.06 = 71 m3
\nThe total volume of the asphalt and binder layers is 7,696 m3 or approximately 16,191 tons, which much lower than the 58,500 tons requested.<\/p>\n
\nThe Bidder has declared the on \u2013 going contract \u201cRoad Milot \u2013 Skuraj\u201d with a value 182,470,379 ALL.
\nThe Bidder has not declared the on \u2013 going contract on the segment \u201cConstruction of Kicevo-Ohrid Motorway Package 5 & 6 (km33 + 740 up to 56+600)\u201d which has a total value of 117,609,360 Euro.
\nThe documents indicating the turnover of year 2016 are not submitted in the acceptable form as per bidding documents BDS 32.2.. They are not presented in compliance with legislation for notarization, legalization, apostille, etc.). Therefor they cannot constitute basis for the bid evaluation.
